Предлагат ми работа е Англия, но имам проблем

Здравейте. Имем предложение за работа в Англия. (аз съм в България). Работодателя ми иска 400 паунда, за работна карта и за работна виза (до колкото го разбирам) а той ще ми плати самолетните билети. Това ми звучи като измама, но все пак искам да знам повече.
Въпросът ми е, по принцип, какъв документ ми трябва, за да започна работа. Казаха ми, че за начало ми е достатъчен и само договор за работа (може би се казва покана , не зная), и веднага след като пристигна мога да си пусна документите за работна карта, и за пин номера, на базата на този договор/ покана.
Та възможно ли да се започне работа само с договор за работа? Или наистина трябва да си платя за да ми пуснат документите за работа, преди да замина. Аз разбирам, че по принцип има доста измамници, и когато ми искат пари, ставам предпазлив.
За това ви моля за малко информация ;-)

Каква работа ти предлагат? Като self employed (самонает, фирма) или като employed (нает, назначен на работа)? И в двата случая не трябва да плащаш предварително. Напиши повече подробности за естеството на работа.

Сегашното ни предложение изглежда много убедително, и за сега не ни искат пари =D>
Сега ни предлагат в 5 звезден хотел да ни наемат за 5 години. Мен за камериерка, а мъжът и за масажист.
Изпратиха ни първо "интервю" с над 30 въпроса. След това ни изпратиха договори за двама ни, да ги подпишем и да ги върнем, а вчера получихме и документи за работна карта/ разрешително за работа. Аз изрично подчертах, че сме от България, и те ми отговориха, че знаят, заради това ще ни наемат за 5 години. Дали им е по-лесно така, да ни наемат пред техните си сънародници, не знам.

Всичко изглежда лигитимно, но аз и не разбирам много ](*,)

Не мога да кача файла. Той е в текстови файл, но не може да се копира садиржанието.

Ще пиша повече утре, като ми отговорят, и ще обясня повече за договора и за този документ за разрешението за работа.

Пет години си е страааашно много време. Няма никаква гаранция, че ще сте доволни от работата. Погледни в договора какви са клаузите при напускане, предизвестие, евентуални неустойки и т.н.
И друго - как стои въпроса със здравното/социалното осигуряване?

CONTRACT AGREEMENT




1.0 Statement of Main Terms and Conditions of Employment.
The ======== Hotel London is represented by the Board of Directors of the =========Group Hotels (London) referred to as the leading hotel of the world. The =========== Hotel London desires to provide you with a written employment contract to enhance administrative stability and continuity within the ========= Group Hotels (London) and we believe that a written employment contract is necessary to describe specifically our relationship with you and this contract to serve as the basis of effective communication between the Management of this hotel and you the employee as you fulfill your administrative function in the operation of the ============Hotel London.



This agreement is made by and between the ====== Group Hotels (London) of 60 Hyde Park Gate, Kensington London, England, United Kingdom referred to as Employer and Petya ===== ======= referred to as Employee entered into this day (15-02- 2012). The ======== Hotel London believe that you has been engaged and have had a great deal of experience in Hotels & Hospitality operations and you are willing to be employed by the ====== Group Hotels (London)
and the ======= Group Hotels (London) is willing to employ you on these terms, covenants, and conditions hereinafter set forth below.



2.0 Main Place of Work.
The work location will be in London at the ====== Hotel London, be sure to report to the HR Manager/Representatives upon arrival to conclude prospects of screening and other logistics.


3.0 Job Title: Chambermaid


4.0 Duties and Responsibilities.
You agree that during your employment period you shall devote your full business time to the business affairs of the ======Hotel and shall perform your duties faithfully and efficiently subject to the direction of the management of the ======== Hotel. You shall not be assigned duties and responsibilities that are not generally within the scope and character associated or required of other employees of similar rank and position. Your duties are as follows:


п‚· Visit guest rooms to change linens. This involves stripping the beds, gathering any dirty towels, making the bed with fresh sheets and hanging unused towels on the racks in the bathroom.
п‚· You are required to vacuum carpeting; mop marble or tile floors; wash windows, television screens, mirrors and other glass; change light bulbs; clean sinks, toilets, showers and tubs; remove garbage; and dust surfaces.
п‚· Replenish any supplies that guests may have used.
п‚· Report any usage of fee-for-service items, as well as damage to the room or its contents and theft to supervisory staff so that the guest can be charged accordingly. In addition, ensure that all appliances, water and heating and cooling systems in guest rooms are functioning properly before new guests arrive.
п‚· Perform various types of customer service for guests, such as delivering newspapers or extra pillows, linens and toiletries; providing turn-down service for beds; picking up laundry, dry cleaning or ironing; and shining shoes.


5.0 Probation.
You agree that the initial three (3) month period of this agreement is "probationary" in the following respects:


i. The Management of ======== Hotel shall review all your original Documents and Certificate upon resumption and your employment shall be terminated if your certificated do not correspond with that which you have provided in your CV.
ii. The Management of ======= Hotel shall have an opportunity to assess your performance, attitude, skills and other employment-related attributes and characters
iii. You shall have an opportunity to learn about both the ====== Hotel and your position of
employment.
iv. You may terminate the employment relationship at any time during the initial three month period without advance notice or justifiable reason.


6.0 Date of Commencement of Employment and Hours of Work.
i. The ====== Hotel hereby employs you as its (Chambermaid) and you agree to serve in such capacity, for the period beginning (19-03-2012) and ending on the date on which your employment is terminated (24-01-2017). If the Management of ======= Hotel does not notify you in writing before (24-01-2017) that your employment contract will not be renewed, it shall be deemed that the Baglioni Hotel has renewed your employment contract for two (2) years extending from the termination date set forth above.
ii. The Hotel working hours for you will be 8hours weekday, 4hours weekend including 8hours sleepover where required. You are entitled to one hour of lunch break every day. Fridays are work free day for our Muslims Employees.
iii. You are also entitled to over-time allowance if your work time exceeds the official stipulated hours. Salary shall be liable to increments with time and employees' official promotions and position in service.


7.0 Compensation.
Subject to the following provisions of this Agreement, during the Employment Period, you shall be compensated for your services as follows:


i. You shall receive an annual net salary after all tax have been deducted, payable in monthly or more frequent installments, in an amount which shall initially be ВЈ24,600.00 GBP per annum, subject to such increases as may from time to time be determined by the Management of ======== Hotel.
ii. Two months’ salary (Inclusive of all allowances & benefits) shall be paid in advance before employee relocates to new job location.
iii. All payments of salary after assumption of duty here in London shall be made in full to your salary account. This is in line with the British Expatriate Financial Statutory Laws.
iv. Housing & Furnishings: ВЈ3,012.63 GBP (Yearly).
v. Old Scheme Housing Loan: One (1) year service to Macdonald Burlington Hotel is required for eligibility. Starter’s amount will be £16,432.00 GBP can be re-paid within ten (10) years with 5% interest.
vi. Car Loan: All Employees are eligible to apply. Starter’s amount will be £6,250.00 GBP can be re-paid within five (5) years
vii. Trafford Business Loan: All Employees are eligible to apply starter’s amount will be
ВЈ11,321.00 GBP to ВЈ30,879.00 GBP annually.
viii. You shall be entitled to participate in any pension or profit sharing plan or other type of plan adopted by the hotel for the benefit of its officers and/or regular employees


8.0 Feeding, Accommodation & Medical/Health.
i. You is expected to reside at the ====== Hotel’s Staff Quarters if they so wish. There are double bedroom and flat options for Employee to choose from.
ii. You are entitled to take meals free of charge at the general staff canteens during your break.
iii. The management of the hotel shall provide you with comprehensive health care for the term of contract and follow-on care for injuries suffered during the term of contract for employee and family.


9.0 Travel Plans/Relocation.
Expenses made/incurred by you related to job before commencement of duties shall be substantiated and reimbursed by the management of the hotel on the conditions stated below:


i. You will be reimbursed by the management of the hotel for reasonable moving expense(s) incurred ONLY as a result of relocation, early termination of leases, storage charges and procurement of travel document, immunizations etc. Reimbursement shall be made before you embark on your trip to London, England, not later than seven (7) working days after submission of Employee’s expense report and receipt from country of origination.
ii. Reimbursement shall be made to ONLY those who applied for them.
iii. Expenses made by you in relation to household equipments, pets, and other personal assets shall not be reimbursed as these would be considered employees responsibility.
iv. You are strongly advised to keep original receipts and evidence of payment(s) of payment
made before arrival in London, England as reimbursement applications made without receipt or evidence of payment shall be denied.

10.0 Leave Period.
i. You must notify the company and/or your immediate supervisor as soon as practicable if you are unable to work for medical reasons. Such notice shall be given within the first four (4) hours of the working day.
ii. Annual Leave: The Employee is entitled to six (6) weeks paid annual leave upon the completion of one year's service from the date of confirmation of your employment.
iii. Sick Leave: The Employee shall be entitled to sick leave and emergency leave according to the
regular policies and procedures of Company. Additional sick leave or emergency leave over and above paid leave provided by the Company, if any, shall be unpaid and shall be granted at the discretion of the board of directors.


11.0 Terms and Termination.
i. The Initial Term of this Agreement shall commence on with respect to the date stated above and it shall continue in effect for a period of 4years. Thereafter, the Agreement shall be renewed upon the mutual agreement you and the ====== Hotel. This Agreement and your employment may be terminated at the discretion of the Baglioni Hotel during the Initial Term, provided that the ===== Hotel shall pay to you an amount equal to payment at your base salary rate for the remaining period of Initial Term. You shall be paid all incentive salary payments and other compensations, prorated or otherwise.


ii. This Agreement may be terminated by you at your discretion by providing at least thirty (30) days prior written notice to the Management of ====== Hotel. In the event of termination by your pursuant to this subsection, the ====== Hotel may immediately relieve you of all your duties and immediately terminate this Agreement, provided that the ===== Hotel shall pay you at the then applicable base salary rate to the termination date included in your original termination notice. You shall be paid all incentive salary payments and other compensations, prorated or otherwise.


iii. In the event that you breach any obligation of the ======= Hotel in this Agreement, habitually neglects your duties to be performed under this Agreement, engages in any conduct which is dishonest, damages the reputation or standing of the ====== Hotel or you are convicted of any criminal act or engages in any act of moral turpitude, then the ========= Hotel may terminate this Agreement upon five (5) days notice to you. In event of termination of the
agreement pursuant to this subsection, you shall be paid only at the then applicable base salary rate up to and including the date of termination. You shall not be paid any incentive salary payments or other compensation, prorated or otherwise.


11.0 Confidentiality.
During and after your employment period, you will not divulge or appropriate to your own use or to the use of others, in competition with the ====== Hotel, any secret or confidential information or knowledge pertaining to the business of the ======= Hotel, or of any of its subsidiaries, obtained by you in any way while you are employed here at the ====== Hotel or by any of its subsidiaries.


12.0 Final Agreements.
This Agreement terminates and supersedes all prior understandings or agreements on the subject matter hereof. This Agreement may be modified only be a further writing that is duly executed by both parties. This Agreement shall be construed and enforced in accordance with the laws of United Kingdom. This Agreement shall be binding upon, and inure to the benefit of, the Baglioni Hotel and its successors. In the event that the ======== Hotel is acquired, or is the non-surviving party in a merger, or sells all or substantially all of its assets, this Agreement shall not be terminated and the
Management of ====== Hotel agrees to use its best efforts to ensure that transferee or surviving company is bound by the provisions of this Agreement.

From 1st January 2007, as European Economic Area (EEA) nationals, Bulgarians and Romanians have been able to move and reside freely in any EU Member State. Bulgarian and Romanian nationals wanting to work in the UK will need to obtain authorization to work before starting any employment. Bulgaria and Romania joined the European Union on 1 January 2007 and as a national of one of these countries, you enjoy certain rights of movement between and residence in, other EU Member States. You will not, however, necessarily be free to take employment in the United Kingdom. If you wish to work in the United Kingdom, it is your responsibility to ensure that you have permission to do so. You may face severe penalties if you work without permission. If you do need to obtain permission to work in the United Kingdom, you will generally need to have an offer of employment in order to obtain that permission. you will normally need to obtain an accession worker card, a registration certificate, National Insurance(N.I) and other supporting documents before you commence employment in the United Kingdom. If you are required to obtain one and you commence working without doing so, you may be committing a criminal offense.

Before you apply for an accession worker card and other documents, your employer will first need to obtain a letter of approval through the existing work permit arrangements. As soon as your employer has applied for your work permit, you will then be able to apply for an accession worker card. Only when the accession worker card has been issued will you be allowed to start work. The accession worker card and other documents will be issued for a specific job. If you then wish to change jobs, you will need to obtain a new accession worker card.

You will be breaking the law if you are working illegally in the United Kingdom. Working illegally can result in an on-the-spot fine of £1000. Your employer can also be fined up to £5000. Once you have been legally employed on a continuous basis for twelve months you are no longer subject to the worker authorization requirement. This means you have a full right to reside under EU law as a worker in a Member State and have an unrestricted right to access that Member State’s labour market. If you do not obtain authorization for your work it will be illegal and will not count towards twelve months legal employment.

Due to the fact that your employer must apply for a work permit before you can apply for the above mentioned documents, we will like to bring to your notice that we have sent the work permit form to your employer to complete and send back to us. we will also update you to inform you of the progress we have made.

The UK Border Agency Certifications will have to embrace the registration and approval of your relevant information with the designated local agencies (Federal Ministry of Foreign Affairs, Commerce and industry respectively with UKBA inclusive). The reason for the review of this policy as communicated by the UK Border Agency is to ensure that expatriates without Letter of Contract and permission do not have to travel down to United Kingdom for any other reason other than the primary aim of commencement of work as required.

The UK Border Agency Certifications will cost you the following:

1. Application for Registration Certificate - £118.00GBP
2. Flight Ticket fee - (will be paid by the Baglioni Hotel)
3. Workers Registration Scheme (WRS) - £90.00GBP
4. DER Expatriates Quota Approval Charge in relevant categories £197.63GBP (will be paid by the Baglioni Hotel)
5. National Insurance(N.I) - £62.80GBP
6. Application for an Accession Workers Card - £82.00GBP
7. Application for Work Permit - £362.80GBP (will be paid by the ======== Hotel)

Total £352.80GBP per person (To be paid by you)

As a result of time constraint for expatriates owing to the work commencement date, we ensure that you forward the information needed for the procurements of your required documents and thereafter we shall inform you on prompt.

You will be required to scan and send immediately:

1. Scanned Completed Application Document/Form(s) which is attached herewith and send the scan copies to us for verification and corrections before we send them to the UK Border Agency

2. An address reachable by courier services for documents delivery.

Other immigration formalities as well as travel tickets will be provided by The ======= Hotel and delivered along side with your relevant documents and other supporting documents (Contract Engagement documents after endorsement)

You are to attach and send the required completed document. This would enable us initiate verification for any possible error and make corrections where required. Hard Copy Agreement Letter, Appointment Letter, Workers Registration Scheme(WRS), National Insurance(N.I), Registration Certificate, Accession Worker Card and Prepaid Flight Tickets inclusive) would be packaged and sent to you via Courier Service Speed Delivery to enable you travel down to your duty location to resume duties in record time.

Note that when completing the forms, You are required to fill in our Address as you address here in UK to make sure that we are contacted if any problem arise. As soon as you immigration documents have been approved, all original documents as well as approved immigration documents will collected from the home office of the UK Border Agency and sent to you along with the hard copies of Agreement Letter, Appointment Letter and Prepaid Flight Ticket. However, We want to use this medium to assure you that we will try our best to make sure that all your immigration documents are approved before you job commencement date.

However as regards your payment, the UK Border Agency have instructed that all payment should be made directly to them. Please also see attachment from The UK Border Agency.

After making the payment, you are required to immediately forward a copy of the proof of payment (payment receipt) to us via scanned email attachment. Please note that our service charges have already been paid by your employer. We do hope that you understand the content of this email and act as you have been instructed to enable us solicit as well as facilitate processing of all the required immigration documents here at the UK Border Agency on your behalf to ensure the successful approval of your immigration documents.
